Regulations on the Usages of Passes in Baltica Wellness & Spa Center
§ 1
1. Baltica Wellness & Spa Center (Center) conducts sale of passes, which give their owners the right to use services of Center under the conditions specified in this Regulations and the Regulations of Baltica Wellness & Spa Center, the content of which is available at the web site www.spabaltica.pl (Passes).
2. Center offers the following types of Passes:
- Wellness area Passes
- Fitness area Passes
- Fit & Spa Passes
- Pass for a set of treatments and solarium
- VIP Pass for the active
§ 2
1. Pass gives the right to use services provided by Center exclusively by the person indicated on such Pass (Pass Holder). If a person is buying a Pass (Buyer) for another person, the Pass individualization shall take place not later than during the first entering Center by Center’s appropriate notification on such Pass.
2. Pass Holder is entitled to use Pass exclusively during Pass validity period specified on such Pass.
3. Pass validity period may be extended exclusively by the Center’s Director and only in exceptionally justified cases.
4. Failure to use Pass within the time periods indicated on Pass results in the expiry of Pass.
5. After the expiry of Pass validity period, Pass Holder is not entitled to require from Center performing a service indicated by such Pass. Additionally, such situation shall not give any grounds for claims related to the service indicated by such Pass, including claims for unfounded enrichment, failure to implement or inappropriate implementation of the service.
§ 3
1. If during the validity period of Pass, Pass Holder fails to use all the services indicated by such Pass, the amount for not used services shall not be refunded by Center.
2. Pass Holder is entitled to use Pass exclusively for a specific treatment for which Pass was issued.
3. In justified cases when Pass Holder is not able to use Pass, if agreed by the Center’s Director, Pass may be transferred to a third party.
4. It is prohibited to resale Pass to third parties.
§ 4
1. Treatments are performed exclusively on working hours of Center, in accordance with the information included at www.spabaltica.pl.
On holidays Center provides services within hours determined separately, in accordance with the information provided in advance at www.spabaltica.pl.
2. Services of Center may be booked by Pass Holder personally or by contacting Center via:
- electronic mail at: baltica@spabaltica.pl, or
- phone:
- + 48 91 359 4400 and + 48 91 359 4401 in case of rehabilitation related treatments,
- + 48 91 359 4402 in case of biological regeneration treatments.
3. The message sent by e-mail should include at least a desired date of the service and:
- the information considering the type of Center’s service to be booked, which is: the treatment, treatments or the Center’s packet name in accordance with a valid offer provided at www.spabaltica.pl.
- in case of treatment cards - if the information is provided by electronic mail – type of the treatment to be booked.
4. An e-mail reservation shall be considered effective when confirmed by Center within 48 hours from the reservation receiving date, to the electronic mail address included in the reservation e-mail.
5. A phone reservation shall be confirmed directly on the reservation moment.
6. In case of a lack of confirmation in a way specified in the above 4 and 5, the reservation shall be considered invalid.
§ 5
1. Center shall not be responsible for any loss or damage of Pass.
2. Center reserves the right to refuse providing services on the basis of Passes which are illegible or damaged. In such case Pass is considered by Center as invalid, without Pass Holder’s right to receive a substitute Pass.
3. Center shall not provide services on the basis of not original Passes. In case of justified doubts considering the originality of Pass, Center reserves the right to refrain from providing the service until such Pass is examined. In case of finding Pass not original, Center shall notify appropriate authorities.
4. Passes are not means of payment. Pass may not be exchanged in Center into cash, as a whole or partially. It may not be exchanged into other Passes or services different from those indicated on Pass.
5. The purchased Pass may not be returned.
6. In exceptional cases, when recognized by Center, Pass purchase price may be returned after the deduction of the carrying charges amounting at 20% of the Pass value. The return of Pass purchase price on conditions specified in the first sentence is possible exclusively after Pass Holder’s presentation of the proof of purchase in the form of a valid receipt or an invoice.
§ 6
1. Buyer and Pass Holder are obliged to get acquainted with this Regulations and the Regulations of Baltica Wellness & Spa Center.
2. If Buyer is a different person than Pass Holder, handing Pass to Pass Holder shall result in the assignment of claims against Center
for the Pass purchase and Pass Holder\'s coming into legal position of Buyer.
3. The purchase of Pass is understood as Buyer’s acceptance of the provisions included in this Regulations and in the Regulations
of Baltica Wellness & Spa Center. Accepting Pass by Pass Holder is understood as Pass Holder’s acceptance of the provisions included herein.
4. Buyer prior to handing over Pass is obliged to inform Pass Holder about the specified herein conditions of using Passes, including the necessity to get acquainted with the content of this Regulations and the Regulations of Baltica Welleness & Spa Center. In case of failing to provide or inappropriate providing the above-mentioned information to Pass Holder, Buyer shall bear a full responsibility due to the fact and is obliged to release Center from any obligations towards the Pass Holder.
